Fair Housing Rights

 

The Fair Housing Act protects individuals and families from descrimination when attempting to buy or rent a home. 

Under the Fair Housing Act, in the sale or rental of housing a landlord or broker may not, based on race, color, national origin, religion, sex, familial status or handicap:

  • Refuse to rent or sell housing

  • Make housing unavailible

  • Deny a dwelling

  • Set different terms and conditions for sale or rental

  • Provide different housing services or facilities

  • Blockbusting, which is the persuasion of owners to sell or rent for profit

In Mortgage Lending, brokers may not, based on race, color, national origin, religion, sex, familial status, or handicap:

  • Refuse to make a mortgage loan

  • Refuse to provide information regarding loans

  • Set different terms on loans, such as high interest rates and fees

If you or someone associated with you has a disability such as hearing, mobility and visual impairments, chronic alcoholism, mental illness, AIDS and mental retardation your landlord may not:

  • Deny your right to make modification to your dwelling or common use areas at your expense (The landlord may permit changes only if you agree to restore the property to its original condition when you leave the property)

  • Refuse to make accommodations in rules, policies and practices, if necessary, for the disabled person to use the housing

Housing for Families

Unless a building or community qualifies as housing for the elderly, it may not deny housing based on familial status.  It may not discrimiate agaist families in which one or more children under 18 live with:

  • A parent

  • A legal guardian

  • This also applies to women who are pregnant

It is illegal for anyone to:

  • Threaten, coerce, intimidate or interfere with anyone exercising a fair housing right or assisting others who exercise that right

  • Advertise or make any statement that indicates a preference based on race, color, national origin, religion, sex, familial status or handicap
